When I think of Marion MA Real Estate my thoughts are of the sea! I envision a major shipbuilding community. This is a seaside town with a history dating back to the late 1600’s where captains of ships who navigated the world returned with goods from great distances made Marion MA their home. Residents of Marion MA can be found enjoying Silvershell Beach year round with Island Wharf near by, some make their way out at Washburn, Old Landing Veterans Memorial or Bicentennial Parks. One of my favorites places to find Marion MA residents is at Music fest. There are town sailing lessons of which offers the best of this seaside community’s rich navigational and shipbuilding history.

There are schools within the Town of Marion MA for students from K-12 offering choice of public education, independent day schools or secondary schools. Each school is recognized for excellence and will serve students well in their academics, sports, and the arts.

Selling Real Estate is a team effort!

Ever try to lift something heavy and felt the weight of the load on your lower back? For a number of agents selling real estate in today’s market has been a strain on them. May I suggest when you interview real estate agents, ask questions to learn how well they work with others. I have found when an agent has an ability to nurture cooperative relationships with agents from other offices, has better served consumers, than an agent who, well let’s just say ... has not been as cooperative!

We all want real estate transactions to go as smoothly as possible, when something does go wrong, however it is right then a real estate agent with a history of cooperation will be worth their weight in gold!

How a real estate agent has performed in the past while resolving problems is a good indicator of how they will work for you, today. Give them some examples of potential problems and see how they respond; what is not said (body language) is equally as important.

Most agent presentations about the service they provide focus on marketing. You may want to listen for words that indicate teamwork; is so very important your agent has a team concept approach to real estate. Which will be more effective, an agent who understands the problems and has solutions that are inclusive of cooperation with other professionals or an agent who gets caught up in the problem? I would really zero in on what the agent says about the people they turn to for help, if they mention this at all.

Certainly, I am writing about cooperative relationships because some agents needlessly struggle alone to resolve real estate sales problems. Imagine for a moment, if your agent hasn’t formed these relationships, how would this affect the out come of your transaction? With fewer closed real estate sales these days, can you afford not to talk with the agent about their maintaining cooperative relationships?

I have built cooperation with people who work in real estate because I want them to get excited about the properties I list. I’ve found that when agents got excited about my listings, the homes sold for more money, in a shorter time, with fewer problems.

It never gets old when other agents tell me how much they appreciated the level of cooperation I’ve provided them with. I pride myself in answering their questions, being accessible to them and always minding my tongue. I’ve seen first hand problems that arise from an agent saying something they should not have said!

Real Estate What Is A Short Sale?

A short sale occurs when the net proceeds from the sale of a home are not enough to cover the sellers’ mortgage obligations and closing costs, such as property taxes, transfer taxes, and the real estate practitioner’s commission. The seller is unwilling or unable to cover the difference.

The presence of two lenders makes a short sale more complicated since it’s often the lender holding the second, or junior, mortgage that has to absorb most of the loss.

What is Involved With a Short Sale

Finding the decision maker is often one of the biggest initial challenges in short sales! The bank’s loss mitigation department, which will be the group to decide whether to accept a short sale, owners / sellers will need to show reason for requesting the Short Sale, submitting to the lender:

  • Letter of hardship must show a true financial hardship; someone with the assets or the income to pay is unlikely to be considered; ANY discrepancies between the seller’s income and the income used to obtain the loan, A big gap may indicate mortgage fraud, unless employment circumstances have drastically changed
  • W-2’s, from employers
  • Two years tax returns
  • Bank statements
  • Financial documents outlining owner’s income and debt obligations
  • Real Estate Broker providing a Comparative Market Analysis to show estimated property value
  • Fully executed Purchase and Sale Agreement; without a viable purchase offer, your deal won’t be considered by mortgagees; I suggest you seek the advice of an attorney before entering into a short sale agreement

Lender may request, but not limited to:

  • Independent Broker Price Opinion
  • Independent Appraisal

What are the options for sellers besides a short sale?

  • Sellers you can call 1 (888) 995 HOPE there are counselors to assist owners who have fallen behind on payments by providing foreclosure prevention information; my company policy is to share this phone number with consumers, more information can be found on my company website www.etruria-properties.com/foreclosure
  • Loan modifications options include extending the term of the loan, add on delinquent payments to the loan principal, and/or reduce the interest rate to make the loan more manageable for the homeowner
  • Repayment plan that requires home owners to increase their monthly payments until the loan is current
  • Refinance an adjustable rate loan with a Federal Housing Authority or conventional fixed loan
  • MassHousing Loan Refinance Program is privately financed through a $190 million commitment from Fannie Mae and a $60 million contribution from MassHousing. Eligible borrowers can be up to 60 days delinquent on their mortgage and have credit scores as low as 560. What prices should buyers anticipate when pursuing a short sale?

  • Most banks have a formula for what percentage under market value they will accept, figures vary from 8 percent under to almost 20 percent under
  • It’s important for buyers to understand that the bank will not give away the property

How long does it take to complete a short sale?

  • Buyers it is critical to understand that response times vary from lender to lender; might take a few weeks or a few months to receive an approval of a short sale from a lender
  • Buyers avoid unnecessary costs, I suggest you should wait on having a home inspection and an appraisal for the loan until after the bank has accepted the short sale proposition

Before you get involved with a short sale, however consider this:

  • My suggestion would be to have an attorney draft an Addendum to the sales contract allowing a short sale contract to be canceled within a set period if the seller is not able to get the ‘Third Party Approval’
  • Also I suggest you have an attorney use language in the contract stating that the lenders must approve the offer (sale) and release all liens on the property
  • A word of caution, sellers you may face a legal problem for failing to execute the contract if the short sale is not approved, so I suggest you have an attorney represent you prior to your entering into any agreements with anyone

From the lender’s point of view:

  • A buyer that is willing to close in 30 days and who can make a substantial down payment may make the deal more attractive than a buyer who wants 95 percent financing. All buyers should be pre-approved for a mortgage before submitting the offer
  • Banks may reject the short sale proposition from too low of a price
  • The bank’s loss mitigation department may have too many files to process and could result in their rejecting your short sale proposition
  • Another possible reason a lender may not be so cooperative is the loan is less than a year or two old
  • The lender may sue for a deficiency and possibly attach other assets rather accept a short sale proposition; again, I suggest you seek the advice of an attorney

What tax liabilities will a seller have as a result of a short sale?

  • Seller must count any amount forgiven by the lender as income and pay taxes on that income, even if no actual money was received. The IRS requires lenders to submit a Form 1099 stating the forgiven amount
  • Sellers who meet the Internal Revenue Service definition of insolvency (either in bankruptcy or with debts exceeding assets) will not have to pay taxes on the forgiven amount
